Same Sex Marriages Finally Legal In California
May 15, 2008 by Scout
The California Supreme Court has just ruled on Same-Sex Marriages. LEGAL under California’s Constitution! Yes!
The ruling, which is not appealable, has said that marriage is such a basic and fundamental right that it should not be withheld from any person or any group and that separate rights for gay and lesbian couples are not EQUAL rights. In other words, a “UNION” is not the same as a marriage. This gives same sex couples the right to go into any California marriage license office and file for a marriage license, beginning tomorrow. The marriages will be equal and not separate from heterosexual marriages.
While this doesn’t directly affect me, I am really excited about it. I have always that the same about the separate but not equal factor of unions. In my opinion, same sex couples should have every right (and by default, every responsibility) given to heterosexual couples. Why not? We’re all the same. When it comes down to it, we’re all the same. Why not honor their right to enjoy(?) marriage and family and all the things that heterosexual couples enjoy?
The case was argued only under California law, not Federal law. This means that the ruling cannot be over-turned by Federal law. If anyone wants to change the ruling, they will have to take steps to change California’s constitution.
I think we’ll see a flood of marriage applications in the morning!
I’m cheering for this one, too! I heard that there’s already a movement to put it in the constitution, though, so that it can’t be declared unconstitutional.
I hope that doesn’t happen. It did here in Oregon. I hope people are getting smarter and not dumber with time.
I was excited about this, too. I live in Ohio where enough people were ignorant enough to vote to change the state constitution so as to ban same-sex marriages.
I think it’s wonderful. Mr. Rizzuto is worried that a bunch of states will put a referendum on the ballot against it in November though, and that that will bring out all the wackos and the Dems will lose. He’s such a buzzkill.
I was just reading an article that raises the issue, Wanda. In it, the writer says that traditionally, this type of referendum on a ballot brings out the very conservative and that influences all of the issues and candidates on the ballot, however it may have the opposite effect in California because the big push has been to get youth registered and inspired to vote in November. In fact, that is who is expected to make the difference in November. That being the case, it is the younger voters who have very liberal views on gay and lesbian issues. Which means that these same young voters will turn out to vote in November and will not only swing the constitutional ban on gay marriages out of the running but will also elect the Democratic presidential candidate.
So, here’s hoping!

Perhaps the rest of the nation will fall in line too.
It needed to be done, and it’s never a “good time” from the point of view of political expediency. I hope you’re right and the young people who don’t even get why anyone would oppose this will carry the vote.
I also think it’s wonderful. It was so depressing to see it legalized and then snatched away again in Oregon a few years ago. I hope it sticks in CA.
This was exciting news. I love progress.
Somehow i missed the point. Probably lost in translation
Anyway … nice blog to visit.
cheers, Magneto.
